Referendum on Continuation of the Pennsylvania Apple Marketing Program

Under the applicable provisions of 3 Pa.C.S. Chapter 45 (relating to Agricultural Commodities Marketing Act), a review referendum was held from March 21 to April 4, 2012, to determine if the producers affected by the Pennsylvania Apple Marketing Program (program) desired to continue the program for an additional 5 years. To pass, a majority of eligible producers voting had to vote in favor of the program's continuation. An impartial Teller Committee met on April 16, 2012, to count the ballots. The following results were submitted by the Teller Committee: a total of 140 eligible votes were cast with 76 producers voting in favor of and 64 voting against the continuation of the program. An additional two ballots were invalid because one producer did not cast a vote and another producer was not eligible to vote. Seventeen ballots cast by affected producers were received prior to the March 21, 2012, start date for the referendum. The 17 ballots were found to be acceptable and were included in this referendum. Votes favoring continuation of the program by number of producers represented 54% of eligible votes and votes against continuation of the program represented 46% of eligible votes. Because a majority of the votes were cast in favor of the program, the program shall continue for 5 years, effective immediately.
